Terms of Service

These Terms govern access to and use of firstrespondr. If you use firstrespondr for an organization, you represent that you have authority to bind that organization.
1. Agreement
These Terms are between Samekar, through firstrespondr, and the individual or organization using the service. If you have a signed order form, enterprise agreement, data processing agreement, or other written agreement with us, that agreement controls where it conflicts with these Terms.
2. The Service
firstrespondr provides AI-assisted workflows for incident investigation, code review, infrastructure operations, data questions, scheduled checks, approvals, notifications, runbooks, and knowledge management. The service may include hosted software, APIs, integrations, infrastructure agents, documentation, and beta features.
3. Accounts and Administration
- You must provide accurate account information and keep credentials secure.
- You are responsible for activity under your account and organization, including users you invite.
- Organization administrators control workspace configuration, integrations, permissions, and access to customer content.
- You must promptly notify us of unauthorized access or security incidents involving your account.
4. Customer Content and Permissions
You retain ownership of content, data, prompts, files, code, logs, schemas, messages, and other materials submitted to or processed by firstrespondr. You grant us the rights needed to host, process, transmit, display, and use that content to provide, secure, support, and improve the service.
You are responsible for having the rights and permissions needed to connect systems, upload content, run tools, query databases, and allow firstrespondr to process data on behalf of your organization.
5. Integrations and Infrastructure Agents
firstrespondr can connect to third-party services and customer-controlled infrastructure. You are responsible for reviewing requested scopes, credential permissions, network access, and command policies before enabling integrations or agents. Third-party services remain governed by their own terms.
6. AI Outputs and Human Review
AI outputs may be incomplete, inaccurate, or unsuitable for your environment. You are responsible for reviewing outputs, recommendations, generated code, database queries, incident findings, runbooks, and proposed remediation steps before relying on them.
firstrespondr is not a substitute for professional judgment, security review, legal advice, compliance advice, or production change management. High-impact actions should be reviewed and approved by qualified humans according to your internal policies.
7. Acceptable Use
You must not use firstrespondr to:
- violate laws, rights, contracts, or third-party terms;
- attempt unauthorized access to systems, accounts, data, or networks;
- disable, overload, disrupt, scan, or attack systems without authorization;
- upload malicious code or use the service to create or distribute malware;
- process sensitive regulated data unless your plan and written agreement expressly permit it;
- misrepresent AI outputs as human-reviewed when they are not;
- benchmark, scrape, reverse engineer, or copy the service except as permitted by law or written agreement.
8. Beta Features
Some features may be marked alpha, beta, preview, experimental, or early access. Beta features may change, break, or be discontinued at any time and may not be covered by the same support, security, or availability commitments as generally available features.
9. Pricing, Billing, and Comparisons
Paid plans, usage limits, overages, taxes, renewals, cancellation, and refunds are governed by the plan terms, checkout flow, order form, or written agreement that applies to your account.
Savings, pricing comparisons, and replacement-stack examples on our website are illustrative. They are not guarantees of savings, feature parity, procurement outcomes, or suitability for every organization.
10. Confidentiality and Security
Each party may receive confidential information from the other. The receiving party will use reasonable care to protect confidential information and will use it only to perform obligations or exercise rights under these Terms. We use reasonable safeguards designed to protect customer content, but no service can guarantee absolute security.
11. Intellectual Property
We and our licensors retain all rights in firstrespondr, including software, interfaces, workflows, designs, documentation, and trademarks. You may use the service only as allowed by these Terms and your plan. Feedback may be used by us without restriction or obligation.
12. Suspension and Termination
We may suspend or limit access if we reasonably believe use of the service creates security risk, violates these Terms, threatens the service, or may expose us or others to liability. You may stop using the service at any time. Certain provisions, including payment obligations, confidentiality, disclaimers, limitations of liability, and ownership terms, survive termination.
13. Disclaimers
Except where expressly stated in a written agreement, the service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free or accurate AI outputs to the fullest extent permitted by law.
14. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or replacement costs. Except for amounts you owe us, each party’s aggregate liability is limited to the amounts paid or payable for the service during the twelve months before the event giving rise to liability.
15. Governing Terms for Enterprise Customers
Enterprise deployments may require additional terms, including data processing, security, support, service-level, procurement, and governing-law terms. Those terms should be documented in a signed agreement or order form before production use.
16. Changes
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating the date above or providing in-product notice. Continued use after changes become effective means you accept the updated Terms.
